Responsibility

Cubania is responsible for compliance with the General Data Protection Regulation (GDPR), maintaining client administration and administration for analysis and marketing purposes. Cubania is the data controller under the GDPR. Cubania is responsible for all data processing on behalf of Cubania, including https://cubania.nl.

Purposes

Cubania collects and processes personal data for the website, personal marketing and to comply with legal obligations.

The personal data stored by Cubania primarily serves the execution of the agreement regarding the delivery of a product and/or service by Cubania. Without this data provision, it is not possible for Cubania to execute the agreement.

Security

Cubania handles your personal data with the utmost care and does everything possible to store your data securely. Any data breaches are always reported to the Data Protection Authority and to the individuals whose personal data may have been compromised. In the event of a data breach, Cubania always takes appropriate measures to ensure the reliability of the website.

If you believe that your personal data is being used improperly, was obtained unlawfully or is being stored without justification, and despite repeated requests you are unable to have your data deleted, you can file a complaint with the Data Protection Authority at any time.

Stored personal data

Cubania stores the following personal data about you:

• For sending newsletters: your name, address, postal code, city, phone number and/or email address.
• For handling questions and complaints: name, address, postal code, city, phone number and/or email address.

Retention period and your rights

Personal data is never stored longer than strictly necessary and can be viewed, modified and deleted by you at any time. When photos or other images depicting natural persons are used, Cubania always first requests permission from the person whose photo or image is being published.

Viewing, modifying and deleting (including the right to be forgotten) and withdrawing consent is possible through the newsletter or by means of an unambiguous declaration addressed to info@cubania.nl.

Deletion of personal data

Your personal data will in any case be deleted:

• In the case of contract execution: 5 years after termination of the agreement for potential future agreements, unless you have explicitly consented to longer storage or the data must be retained based on a legal regulation.
• In the case of paying and processing invoices: 7 years after payment of the relevant invoice, to comply with the legal obligation of the Tax Authority.
• In the case of handling questions and complaints: after the complaint has been resolved to satisfaction.
• In the case of the newsletter: after unsubscription.

Third parties

For the proper execution of the agreement, Cubania may use a number of third parties who may also gain access to your data. In any case, they will store the data for as long as necessary for the execution of their work. Personal data will never be used for purposes other than Cubania's operations, unless explicit consent has been requested. Data processor agreements apply to all external transfers of personal data.

An email service provider is used for sending the newsletter. Personal data necessary for sending the newsletter is provided to the email service provider.

Blacklist

Cubania reserves the right to create a blacklist regarding personal data of individuals who have seriously damaged Cubania's trust. The blacklist is kept indefinitely and is only accessible to a very limited group of Cubania employees. The blacklist is maintained, also for future offerings from Cubania. Individuals who, despite repeated requests, fail to meet any payment obligation to Cubania will in any case be placed on the blacklist.
